A Proven Criminal Defense Team

Protecting the Rights of CDL Holders After DUI

If you are a Colorado commercial driver with a CDL, a DUI or traffic offense may be the end of your driving career. Either criminal or even an administrative violation and conviction can result in your commercial driver’s license CDL being revoked for one (1) year. Did you realize that it doesn’t matter if you were driving your truck for work, or your car during leisure time?

If you have a valid commercial driver’s license and you do not take your traffic or criminal charges seriously, you may be done driving your truck for an entire year, as your CDL will be revoked if you received a guilty finding in court or at a DMV hearing. Sounds harsh? It is, and we won’t stop fighting for you, so don’t give up on yourself and call us today to talk about your options. Our lawyers understand what is at stake and will fight for you every step of the way at 720-407-2582.

CDL Frequently Asked Questions

I am a trucker with a CDL and I just got a DUI ticket. Is my career over?

That is a good question, and a lot of other questions must be answered before we know what will happen with your CDL. Was your blood alcohol content .170 or higher? If yes, call us right away and don’t wait! If you go to the DMV hearing alone and an administrative DMV hearing judge find you at fault, or even if you win your hearing and go to traffic court and are found guilty of your DUI or a DWAI there, then you will not be able to obtain a CDL until all your DMV-ordered interlock requirements are met and the ignition interlock device is no longer a requirement or part of your driving privilege requirements. We can help.

So I got a DUI of .170 and then I had to get an interlock machine for my car. When can I get my CDL back?

The math is simple but harsh. If your BAC was at or over .170, you have to go a month without driving, as those are the Colorado DMV rules. Then, once you get your license, you will be required to have an interlock device on your vehicle for 24 additional months. That’s 25 months total, which is over two years! Can you afford to not have your CDL for over two years?

I have a prior DUI and just got another DUI. Is my career as a trucker over?

It is very possible you are looking at a new career. But for Colorado to ban your CDL for life, you have to get two lifetime DUIs, and both DUIs have to be received after you got your CDL and both have to be received after October 1, 2005. A second offense will result in a lifetime disqualification of the commercial driver’s license.
