Assault charges in Colorado can happen to anybody, anytime!

The Pueblo Chieftain reports that the Pueblo Police arrested a woman by the name of Tara Tapia after she called the police on herself.

According to the Pueblo Chieftain, Tapia's boyfriend stated to police that when Tapia returned home from work he decided to confront her about a box of condoms he found in the kitchen. Tapia's boyfriend told the police that Tapia has a drinking problem which causes her to fight/argue with him and that Tapia's daughter told him she had been drinking that night. Apparently, when Tapia's boyfriend confronted her about the condoms, she became angry, started yelling at him, and threw his clothes into the backyard. Tapia's boyfriend reports that after Tapia could not provoke him to hit her, she pushed him into the kitchen sink, and stabbed him in the arm with a kitchen knife. Tapia reportedly told police that when her boyfriend found the condom -he beat her up. Tapia is accused of second-degree assault/domestic violence in Colorado. She is presumed innocent until proven guilty.

Is Tapia's boyfriend the victim or the aggressor? Does Tapia have a defense? Is it a good idea to confront your spouse about the condoms when you know she/he is drinking and has a tendency to fight with you when you think she/he is drinking?
