A gentleman by the name of Thomas Hammond who is accused of Pimping and Pandering is currently on trial in Albany, New York for Sex Trafficking charges. Mr. Hammond decided to represent himself at trial on this very difficult and challenging sex crimes case. During his opening statement to the jury, Mr. Hammond admitted that he used cocaine with his "girls" whom he called prostitutes. He then went on to discuss how he merely provided them with "protection that's needed".
Mr. Hammond then sprung the Ace up his sleeve on the jury and prosecution by confessing that: "The evidence will show that these charges I'm being charged with are federal charges, me crossing state lines committing an act of a crime...the evidence will prove to you that the federal agents investigated this same case" and since the feds decided NOT to prosecute, the state has no leg to stand on and the jury should find him NOT GUILTY! BOOM! Or maybe not so much of a Boom?
At one point during the trial, it occurred to Mr. Hammond that he is not doing very well by himself. He agreed to have a state appointed criminal defense attorney begin representing him. It is not clear whether this happened before or after he confessed to a jury that he is a heroin addict and can prove it. If Mr. Hammond is convicted, he is looking at up to 25 years in the state prison. As amusing as this may seem to start, it is as serious as a heart attack for a person charged with a sex crime.
I say this over and over to people, and the story above illustrates why. If you are charged with prostitution in Colorado, Pimping, Pandering, or any other sex crime like Internet Luring, Enticement of a Child, Sex Assault, Sex Assault on a Child in Denver, Arapahoe, Adams County Jefferson County, or any of the Front Range cities or counties, please, please, please, don't try and do this by yourself. These are not minor infractions; they are life changing felony sex crimes in Colorado and carry with them life-changing sentences, sometimes up to 20 years to life on probation, or up to 10 years to life in prison. Colorado sex crimes generally carry "Indeterminate" sentences which means the sex crime sentences don't have an end date, just a start date.
