What can happen when a DA is charged with drunk driving

County prosecutors are tasked with seeking justice against those who break the law. In Colorado, prosecutors are vigilant about protecting the public from those who get behind the wheel without regard to how their impairment can lead to tragic deaths. 

It is also inherent that prosecutors are held to a higher standard when it comes to drinking and driving. So what could happen when a district attorney is charged with driving under the influence of alcohol? The answer could be realized after analyzing a situation involving a Texas based prosecutor. 

A Travis County, Texas prosecutor has been charged with driving while intoxicated after being involved in a traffic accident. Brandon Grunewald will be prosecuted by the same office he works for. According to Austin police officers, the prosecutor refused to take a breath test at the scene of the accident. As such, he was taken into custody and given a blood test. The report (provided by the Associated Press) did not indicate what his blood alcohol level was at the time of the arrest.

While the charge is certainly ironic, it is not without precedent. The sitting district attorney in Travis County, Rosemary Lehmberg, was prosecuted for DWI in April. She pleaded guilty and served time in jail. She ultimately resumed her post despite fervent calls for her to step down. In fact, Gov. Rick Perry called for her to resign and even cut funding to her office. 

In the meantime, the Grunewald charges are a prime example that everyone (even prosecutors) can be charged with a crime. Just like other offenders, they are entitled to a vigorous defense.
