Domestic violence charges involving woman are dropped

Domestic violence is a crime generally associated with male partners is a relationship, but occasionally women can be charged with the crime as well. In a nationally publicized story, domestic violence and assault charges were recently dismissed against a woman that was accused of punching and biting a former college football star, Maurice Clarett.

The woman that was charged did have to provide documentation to the court that she had completed counseling. One prosecutor stated that this was not an uncommon method for dealing with such charges when the individual being tried had no prior criminal record.

In the past, Clarett had been suspended indefinitely from the football team for supposedly filing a false police report and apparently lying to NCAA investigators. He had previously served more than three years in prison, and recently told reporters he was giving motivational speeches and was self-publishing a book for young people.

There is often more than one side to domestic violence cases, and clarifying precisely what happened is not always easy to do. Also, what occurs in such incidents may be perceived differently by the two individuals involved.

The job of criminal defense attorneys is to make certain that any allegations raised in court be scrutinized to determine whether what was alleged is true. Their job is also to place whatever actually did happen into context.

Individuals should not be convicted of crimes based upon allegations alone, and there does need to be at least some sort of proof before individuals are fined or sentenced to spend time in jail.
