Designated driver arrested for DUI

We encourage people to seek designated drivers or use taxi cabs (instead of driving) when they are out on the town. It is the easiest way to avoid being arrested for DUI or DWAI in Colorado. At Colorado State University, students may take advantage of RamRide, a service dedicated to transporting students who have been drinking.

In a troubling irony, RamRide driver was stopped and arrested on suspicion of drunk driving in the early hours of Friday morning. The Rocky Mountain Collegian reports that campus police charged the driver with speeding, driving under the influence of alcohol, marijuana possession and possession of drug paraphernalia.

All the charges are misdemeanors under Colorado law.

No reports were released regarding the student’s age, their blood alcohol content, or the amount of marijuana allegedly found. Except for a navigator, there were no other students onboard the vehicle.

Student body officials were surprised to hear about the arrest. Before volunteering, students sign a pledge acknowledging that they will not drive any RamRide vehicles while under the influence of drugs or alcohol. Despite screening efforts, one driver has allegedly broken the pledge.

There are a number of questions to be answered as the legal process begins. They center around the basic reasons for the stop (i.e. did the officer have a reasonable suspicion to justify stopping the vehicle), what sobriety tests were conducted (i.e. walk-and-turn, nystagmus gaze), whether a field breathalyzer test was conducted, and where there was sufficient probable cause to justify an arrest.

It remains to be seen what the outcome will be, but it is certainly a compelling irony for a designated driver to be arrested for DUI.
