Crimes involving damage to property can be charged at different levels and in different courts. For instance, lower-level property damage charges are usually filed at the municipal level and are deemed "destruction of property." Higher-level property damage is filed at the state level and is termed "criminal mischief." Each charge is based on value of the damage and can be a misdemeanor or felony charge based on the total amount of money it would cost to repair the damaged items or property.

Criminal mischief and destruction of property charges can result from intentional property damage through vandalism, insurance fraud and other deliberate acts. Often, however, charges can result from unintentional criminal acts.
